Terms

How box4u works for the businesses that list box4u Bags and for the people who reserve them. We've kept these as plain as we can.

Last updated 19 October 2026 · Operated by ServiceBaba Pty Ltd, ABN 90 695 084 309, Sydney NSW (“box4u”, “we”, “us”).

Terms for businesses

These apply to cafés, bakeries, restaurants, grocers and other businesses (“Merchants”, “you”) that list box4u Bags.

1. About these terms

By creating a Merchant account or listing a box4u Bag, you agree to these terms on behalf of your business. Anything we agree with you in writing during onboarding (for example, a founding-partner arrangement) forms part of these terms. If something in that written arrangement conflicts with these terms, the written arrangement applies.

2. How box4u works

box4u is an online marketplace. It lets you offer your end-of-day surplus food to people nearby as “box4u Bags” for in-store collection.

When a customer reserves a box4u Bag, the sale is made by you to the customer — you are the seller of the food. box4u acts on your behalf to publish your listing, take the reservation and collect payment. We don't prepare, store, pack, inspect, handle or deliver food, and we never take possession of it.

3. Your account

  • You must be at least 18 and authorised to act for a business that holds an active ABN.
  • The details you give us (business name, address, contact person, payout details) must be accurate and kept up to date.
  • Each store location needs its own account. Keep your login secure. You're responsible for activity under your account, including by your staff.

4. Listing box4u Bags

You decide what goes into each listing: a short description of what a bag usually contains, how many bags, the retail value, the price and the pickup window.

  • The description should fairly reflect what customers typically receive. Because contents depend on what's left each day, a general description such as “assorted breads and pastries” is fine.
  • The retail value shown must be a genuine estimate of what the contents would normally sell for in your store, and each bag should contain food worth at least that amount.
  • box4u Bags must not contain alcohol, tobacco, or any item that needs age verification or a prescription.
  • If you know you won't have enough to fill your listed bags, reduce the quantity or cancel in your dashboard as early as you can.

5. The food you supply

As the business preparing and handing over the food, you're responsible for it in the same way you are for anything sold over your counter. In particular, you confirm that:

  • you hold, and will keep, every registration, licence and notification your food business needs, including with your local council and the NSW Food Authority where required;
  • all food in a box4u Bag is safe and suitable to eat, and has been prepared, stored, packed and handled in line with the Food Act 2003 (NSW), the Australia New Zealand Food Standards Code and any other applicable law;
  • food is within its use-by date at handover, and anything that needs temperature control has been kept and is handed over at the correct temperature;
  • you'll provide labelling, ingredient and allergen information in the same way the law requires for your normal sales, and answer customers' questions about allergens and ingredients when asked; and
  • you'll remove affected items and tell us promptly if any food you've supplied through box4u is subject to a recall or a food-safety concern.

6. Pickup

Please honour every confirmed reservation. At pickup, check the customer's 4-digit code against your dashboard and hand over the bag within the pickup window. If you can't fulfil a reservation (for example, you closed early or sold out), cancel it in your dashboard as soon as possible so the customer is refunded and notified.

7. Prices, payments and payouts

  • Price. You set the customer price, within the guidance shown in your dashboard. Customers typically pay about a third of the retail value.
  • Collecting payment. We collect payment from customers as your agent through our payment provider. Once a customer has paid box4u, they have paid you for that bag.
  • Payouts. We pay you the amounts collected for your box4u Bags, less any applicable fees and any amounts under section 8, on the schedule shown in your dashboard.
  • Fees. Founding partners pay no fees during their founding period (the first month after your shop goes live). We'll give you at least 30 days' written notice before any fee starts or increases, and you can stop using box4u at any time before then.
  • GST. You're responsible for any GST on your sales of box4u Bags. If we charge fees, we'll issue you a tax invoice for them.

8. Customer feedback and refunds

Customers may contact either you or us about a box4u Bag. To keep things simple for both sides, we may handle the first conversation for you and decide on a refund or credit where the bag:

  • wasn't available or handed over during the pickup window;
  • was materially different from your listing; or
  • contained food that wasn't of acceptable quality or wasn't safe to eat.

Where a refund or credit is given for one of these reasons, the amount may be deducted from your next payout. Where practical, we'll let you know and give you a chance to respond first. Refunds we give for reasons that have nothing to do with you (for example, an app fault) come out of our pocket, not yours.

9. Customer information

You'll see limited details about customers (such as a first name and reservation code). Use them only to fulfil the reservation, and handle them in line with the Privacy Act 1988 (Cth) and our Privacy Policy. Don't use them for your own marketing unless the customer has separately agreed.

10. Brand and content

You allow us to use your business name, logo, photos and listing details in the box4u app, on our website and in our promotion of box4u, for as long as you're listed (and for a reasonable time afterwards for materials already published). You confirm you have the right to give us that content. box4u's name, app and materials remain ours. You're welcome to use the signage and graphics we provide to tell customers you're on box4u.

11. Claims and insurance

You agree to cover box4u for any loss, cost (including reasonable legal costs), fine or penalty that results from a claim about the food you supplied, from your breach of these terms or of the law, or from anything that happens at your premises — except to the extent the loss was caused by box4u's own negligence or breach.

You must hold public and product liability insurance of the kind a reasonable food business of your type would hold, and keep it current while you list on box4u.

12. Our liability

We'll provide the box4u platform with due care and skill, but we can't promise it will always be available or error-free, or that every bag will sell. To the extent the law allows, we aren't liable for indirect or consequential loss, or for lost profits or revenue. Our total liability to you in any 12-month period is limited to the greater of the fees you paid us in that period and $100. Nothing in these terms limits any right you have that can't be limited by law, including under the Australian Consumer Law.

13. Ending the arrangement

There's no lock-in. You can pause or stop listing at any time from your dashboard, or by emailing us. We may suspend or end your listings if you seriously or repeatedly breach these terms, if we receive credible food-safety complaints, or if we stop offering box4u in your area. Where we can, we'll tell you first and explain why. Reservations already paid for must still be honoured or cancelled and refunded. Sections 5, 8, 11 and 12 continue to apply to sales made before the arrangement ended.

14. Changes and general

We'll give you at least 30 days' notice by email of any change to these terms that's material to you. If you don't agree, you can stop using box4u before the change takes effect. These terms are governed by the laws of New South Wales, and the courts of New South Wales have jurisdiction. If part of these terms is unenforceable, the rest still applies. We may transfer our rights under these terms to a successor of the box4u business; you need our written consent to transfer yours.

Terms for customers

These apply when you use the box4u app or website to find, reserve and collect box4u Bags.

1. About these terms

By creating an account or reserving a box4u Bag, you agree to these terms. Please read them along with any information shown in the app when you reserve, and our Privacy Policy, which explains how we handle your personal information.

2. Who you're buying from

box4u Bags are sold by the local businesses listed in the app (“Merchants”). When you reserve a bag, your purchase is from that Merchant. box4u runs the marketplace and takes your reservation and payment on the Merchant's behalf.

The Merchant prepares, packs and hands over your bag, and is responsible for the food in it.

3. Your account

You must be at least 16 to create an account. Please give us accurate details and keep your login secure — you're responsible for reservations made from your account.

4. What's in a box4u Bag

A box4u Bag is made up of food the Merchant has left at the end of the day, so the contents change from day to day and you can't choose specific items. The listing describes what a bag usually contains, and the retail value is the Merchant's estimate of what the contents would normally sell for.

5. Allergies and dietary needs

Because bags are put together from what's left on the day, they may contain or have been in contact with common allergens, and may not suit every diet. If you have an allergy, intolerance or dietary requirement:

  • ask the Merchant about ingredients and allergens before reserving or when you collect — they're the best people to tell you what's in their food;
  • check the items and any labels before eating; and
  • if you're not sure an item is right for you, don't eat it.

6. Reserving, paying and collecting

  • You pay when you reserve. The price shown includes GST where applicable.
  • Collect your bag in person at the Merchant's store during the pickup window shown, and show your 4-digit code.
  • If you don't collect within the pickup window, the Merchant may release the bag and it won't be refunded, except where the law requires.
  • If the Merchant has to cancel your reservation, you'll get a full refund to your original payment method, usually within 5–10 business days.

7. Looking after your food

box4u Bags are surplus food and are usually best enjoyed the same day. Please follow any storage or reheating instructions the Merchant gives you, refrigerate anything perishable promptly, and check use-by dates and packaging when you collect.

8. Cancellations and refunds

The app shows whether, and until when, a reservation can be cancelled at the time you reserve it.

If something's wrong with your bag — it wasn't available, it was very different from the listing, or the food wasn't of acceptable quality — let us know in the app or at [email protected] within 24 hours of the pickup window, with a photo if you can. We'll work it out with the Merchant and arrange a refund or credit where appropriate.

9. Your consumer rights

Nothing in these terms excludes, restricts or changes any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.

10. Our role and liability

We're responsible for providing the box4u app and website with due care and skill. The food itself is supplied by the Merchant, who is responsible for it as described in section 2.

We can't guarantee that the app will always be available, or that a particular bag will be on offer on a given day. To the extent the law allows, we aren't liable for indirect or consequential loss, and our total liability to you in connection with any reservation is limited to the amount you paid for it.

11. Using box4u fairly

Please don't reserve bags you don't intend to collect, resell box4u Bags, use bots or false details, or treat Merchants' staff with disrespect. We may limit or close accounts that do. Reviews and photos you share must be honest and your own, and you allow us to display them in the app and on our website.

12. Changes and general

We may update these terms from time to time. We'll show the date of the latest version on this page and tell you in the app about significant changes. These terms are governed by the laws of New South Wales. Questions? Contact us at [email protected].
